1. Acceptance of Terms

By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use immediately.

2. Definitions

• "Brand": Companies or individuals seeking influencer marketing services
• "Influencer": Content creators who collaborate with Brands through the Platform
• "Campaign": Marketing initiatives created by Brands
• "Review": Content submissions by Influencers for approval
• "Supported Platforms": Instagram, TikTok, Shopee, and Tokopedia

3. User Accounts

• You must provide accurate, current information during registration
• You are responsible for maintaining account security
• One account per user; sharing accounts is prohibited
• Accounts found in violation may be suspended or terminated

4. Services Provided

For Brands:

• Campaign creation and management
• Influencer discovery and collaboration
• Performance analytics and reporting
• Review and approval workflows

For Influencers:

• Campaign participation opportunities
• Content submission and tracking
• Payment processing for approved work
• Performance metrics dashboard

5. User Conduct

You agree NOT to:

• Upload false, misleading, or fraudulent content
• Manipulate metrics or engagement data
• Violate any third-party rights or platform policies (Instagram, TikTok, Shopee, Tokopedia)
• Use the Platform for illegal activities
• Harass, abuse, or harm other users

6. Content and Intellectual Property

• You retain ownership of content you create
• By submitting content, you grant us a worldwide, non-exclusive license to use, display, and distribute it for Platform operations
• You represent that you have all necessary rights to submitted content
• We reserve the right to remove content that violates these Terms

7. Payment Terms

For Brands:

• Campaign budgets must be funded before activation
• Payments are processed upon review approval
• Refunds are subject to our Refund Policy

For Influencers:

• Payments are released after Brand approval
• Payment methods and schedules are outlined in campaign agreement
• Taxes are your responsibility

8. Third-Party Platforms

• You must comply with the terms of service of Instagram, TikTok, Shopee, and Tokopedia
• We are not responsible for changes to third-party platform policies
• Integration issues with third-party platforms may affect service availability

9. Limitation of Liability

• Platform is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Maximum liability is limited to amounts paid to us in the past 12 months

10. Dispute Resolution

• Disputes will be resolved through binding arbitration
• You waive the right to class action lawsuits

11. Modifications

We reserve the right to modify these Terms at any time. Continued use constitutes acceptance of updated Terms.

12. Termination

• Either party may terminate the agreement with notice
• We may terminate accounts immediately for violations
• Upon termination, pending obligations remain in effect

14. Applicable Indonesian Law

This Privacy Policy complies with Indonesian laws and regulations, including:

• UU No. 27 Tahun 2022 tentang Perlindungan Data Pribadi (Personal Data Protection Law): We process and protect your personal data in accordance with PDP requirements, including obtaining consent, ensuring data security, and respecting data subject rights.
• UU No. 19 Tahun 2016 tentang Perubahan atas UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE Law): Electronic transactions and information on this Platform are legally valid and binding.
• UU No. 8 Tahun 1999 tentang Perlindungan Konsumen (Consumer Protection Law): Users are entitled to consumer rights including accurate information, fair treatment, and complaint mechanisms.
• UU No. 28 Tahun 2014 tentang Hak Cipta (Copyright Law): All content, including user-generated content, is protected by intellectual property rights.
• Peraturan Pemerintah No. 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik: We maintain secure and reliable electronic systems and transactions.
• Peraturan OJK yang relevan: Payment processing and financial transactions comply with applicable Financial Services Authority regulations.
• Undang-Undang Perpajakan: All transactions are subject to applicable Indonesian tax laws including PPh and PPN.

Any disputes arising from the use of this Platform shall be resolved under Indonesian law and the exclusive jurisdiction of Indonesian courts.
